Pennsylvania DUI Laws
75 Pa.C.S.A. 3802

As a DUI attorney in Pittsburgh, Rob Goehring is familiar with the DUI statute.   Some of the major points of the Pennsylvania DUI are summarized as follows:

With the passage of the new D.U.I. law there are now three BAC categories: .General Impairment  -  .08 to .099 , High Rate of Impairment  - .10 - .159 and Highest Rate of Impairment  -  .16 and above.   Additionally, it is possible to receive a D.U.I. if you are under the influence of a controlled substance.  With regard to minors operating a vehicle with alcohol in their system, the legal limit is .02.

In Pennsylvania the penalties become more severe the higher your blood-alcohol level is and also with each subsequent offense.

Under Pennsylvania law a driver of a vehicle may be asked by a police officer to submit to a blood test or to use a breathalyzer.  If the driver refuses to take either of these tests, the driver fails to comply with either request then there is a mandatory one-year license suspension.
For some, the most severe consequence of being convicted of a D.U.I. in Pennsylvania is the loss of their driving privileges.
